TERMS USED IN THE AGREEMENT
1.1. The seller is MB PRO PACE uniti, whose goods and educational services are sold on the website www.propace.lt in accordance with these Rules and which is responsible for the execution of the order submitted by the Buyer.
1.2. Buyer - an able-bodied natural person (a person who has reached the age of majority, whose capacity is not limited by court order) or a legal entity who purchases goods and services on the website www.propace.lt
1.3. Parties - Buyer and Seller together.
1.4. Rules - these "Purchasing - selling on the website www.propace.lt" rules, which are applied to every purchase of the Buyer on the website www.propace.lt and to the Purchase and Sale Agreement concluded between the Parties.
1.5. Educational activity - consultations, lectures, seminars or other form of educational activity, which the Buyer purchases on the website "www.propace.lt" and receives all the necessary information about the purchased Educational activity at the specified e-mail address (specified at the time of purchase).
1.6. Courses for adults are seminars conducted remotely, which have a scheduled date and time, the structure of the educational activity and the validity period of the activity. When purchasing Courses on the www.propace.lt website, the buyer must be thoroughly familiar with the publicly available material of the Courses.
1.7. Contract - the purchase and sale contract concluded by the Buyer and the Seller, which is considered to be concluded after the confirmation of the order, i.e. moment of order payment.
GENERAL PROVISIONS
2.1. The buyer approves the Rules after familiarizing himself with them and ticking the box next to the statement "I have familiarized myself with the rules of purchase and sale on the www.propace.lt website and I agree with them". The Rules approved in this way are a binding legal document for the Parties, which determine the rights and obligations of the Buyer and the Seller, the conditions for purchasing and paying for goods or services, the procedure for refunding money, the parties' responsibilities and other conditions related to buying and selling on the website www.propace.lt.
2.2. By purchasing a service/product on the website www.propace.lt, the buyer confirms the rules.
2.3. For the sake of clarity, it is indicated that there are no possible situations where the Buyer agrees and undertakes to comply with the Rules with certain exceptions. If the Buyer has comments or wants to act in a different way than that specified in the Rules, it is required to obtain the prior written consent of the Seller or to wait until the Rules are changed accordingly.
2.4. The seller has the right to change, correct or supplement the Rules. The amended Rules are published on the website. All amendments and additions to the Rules shall enter into force from the moment of their publication, except in cases where a later date of entry into force of the amendments and additions to the Rules is clearly and unambiguously indicated.
2.5. The buyer must familiarize himself with the Seller's Privacy Policy published publicly on the website. The processing of the buyer's personal data is carried out in accordance with the applicable legal acts and the Privacy Policy published on the Training website.
2.6. If the Seller has the right or obligation to provide the Buyer with information or documents by e-mail, in all cases, the Buyer is responsible for providing the Seller with a working e-mail address belonging to the Buyer.
THE MOMENT OF CREATING A LEGAL RELATIONSHIP OF PURCHASE - SALE
3.1. When ordering goods and services on the Payments website, the Buyer must indicate in the information fields provided in the system the personal data necessary for the proper execution of the order for goods and services, which are processed by the Seller in accordance with the Privacy Policy.
3.2. When the Buyer, after choosing the goods or services to be purchased and forming a basket of goods, completes all the steps of the order, the last of which is the selection and confirmation of the payment method, it is considered that the purchase-sale legal relationship has emerged between the Seller and the Buyer and a purchase-sale contract has been concluded. The Buyer is informed about the payment confirmation by submitting a notification to the e-mail specified by the Buyer.
3.3. Each Buyer's order is stored in the Seller's database in accordance with the procedure specified in the Privacy Policy.
BUYER'S RIGHTS AND OBLIGATIONS
4.1. The buyer has the right to purchase goods and services on the website www.propace.lt in accordance with the rules.
4.2. The buyer has no right to refuse the order and terminate the Agreement
4.3. The buyer, using the "www.propace.lt" website, must fulfill his obligations, comply with these Rules, the Privacy Policy and not violate the legal acts of the Republic of Lithuania.
SELLER'S RIGHTS AND OBLIGATIONS
5.1. The Seller has the right to cancel the Buyer's order without prior warning, if the Buyer does not pay for the goods and services placed in the shopping cart within 3 (three) working days. The Seller undertakes to fulfill the Buyer's orders in the manner set forth in these Rules and to communicate with the Buyer through the contacts indicated on the Training website only on questions, directly related to the purchase of goods and services, in compliance with these Rules and the Privacy Policy.
5.2. The Seller undertakes to respect the Buyer's privacy, to process the Buyer's personal data only in accordance with the Rules, the Privacy Policy, and the legal acts of the Republic of Lithuania and the European Union.
5.3. The Seller undertakes to fulfill other obligations imposed on the Seller in the Rules and legal acts of the Republic of Lithuania.
5.4. The seller assumes responsibility for the quality of the services provided, but not for the result.
PAYMENT PROCEDURE
6.1. Prices of goods and services on the Training website are indicated in euros, including the amount of VAT applicable at the time and other taxes, if applicable.
6.2. The Buyer can pay for the ordered goods and services using electronic banking or in cash after prior agreement with the seller.
6.3. The order is confirmed when the Seller receives payment for the goods or services.
6.4. If the buyer wishes, an invoice may be issued not in his name, but to a company or other institution. In this way, the invoice is drawn up and sent to the Buyer within three working days from the receipt of payment.
DELIVERY OF GOODS AND SERVICES
7.1. Remote Courses purchased by the Buyer, consultations and all their materials become personally available to the Buyer according to the procedure provided by the Courses. By means of an information letter, the Buyer is informed about access to Course training.
RULES FOR TERMINATION OF THE PURCHASE-SALE CONTRACT AND REFUND PROCEDURE
8.1. Money paid for the purchase of Educational activities, Courses and other services sold on the www.propace.lt website are non-refundable.
8.2. The procedure provided for in the legal acts of the Republic of Lithuania applies to the return of goods.
8.3. If the buyer starts the order and does not complete it (fails to pay), the purchase and sale transaction is considered not to have taken place.
RESPONSIBILITY
9.1. In case of violation of the Rules, the Buyer's ability to use the Payment Site may be suspended indefinitely. Suspension of access means that the Buyer cannot log into the Account.
9.2. The Seller is released from any responsibility in cases where the losses arise because the Buyer, regardless of the Seller's recommendations and his obligations, did not familiarize himself with these Rules and the Privacy Policy, although he was given such an opportunity.
FINAL PROVISIONS
10.1. All communication related to the purchase of goods and services using the www.propace.lt website is carried out through the contacts indicated on the website. In the event that the Buyer and the Seller carry out communication related to goods or services in other ways than through the website, the Seller does not assume any responsibility or risk that may arise from such communication.
10.2. All disagreements arising from the implementation of these Rules shall be resolved through negotiations. In case of failure to reach an agreement, disputes are resolved in accordance with the procedure established by the legal acts of the Republic of Lithuania.
